Alternate Dispute Resolution

Land has been and continues to be a major source of conflict. Resolution of these conflicts through the courts can be very expensive and time-consuming, and beyond the means of most citizens, particularly the poor. Alternative Dispute Resolution (ADR) is any procedure that is applied prior to or during disputes between two or more parties, other than litigation. It includes dialogue and negotiation, which involve only parties to the dispute, facilitation, conciliation and mediation, that involve a third party, and arbitration that also involves a third party but with decision-making power (see accompanying figure). Major benefits of ADR are cooperative compliance with the agreement, the creation of positive relationships, increased flexibility, and reduced costs. Terradigm has an expert group in ADR with broad experience in a variety of environments.
